Mochi End-User License Agreement

This End-User License Agreement ("EULA") is a binding contract between you ("you", "User") and Mochi (the "Service"). By creating an account or using Mochi you agree to this EULA. If you do not agree, do not use Mochi.

This EULA incorporates by reference the Apple Standard EULA when Mochi is delivered through the Apple App Store, and the terms below add to and clarify that agreement.

1. License

Mochi grants you a personal, non-exclusive, non-transferable, revocable license to use the Mochi mobile application on any compatible device that you own or control, solely for your personal, non-commercial use.

2. User-Generated Content — Zero Tolerance

Mochi has zero tolerance for objectionable content or abusive behavior. You agree not to upload, post, transmit, share, or otherwise make available through Mochi any User-Generated Content ("UGC") that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, sexually explicit, hateful, racially or ethnically offensive, or otherwise objectionable.

3. User Responsibility

You are solely responsible for the content you upload to Mochi and for the consequences of posting or sharing it. You represent and warrant that you have all rights necessary to post your content and that your content does not violate this EULA or any applicable law.

4. Reporting and Moderation

Mochi provides an in-app reporting mechanism on every clip, message, and user profile. Reports are reviewed by a human moderator within 24 hours. Users can also email reports to support@mochilog.app.

5. Right to Remove Content and Suspend Accounts

Mochi reserves the right, but has no obligation, to monitor, review, remove, block, or refuse to make available any UGC at our sole discretion. Without limiting the foregoing, Mochi may:

  1. Remove any UGC that violates this EULA;
  2. Suspend or terminate the account of any user who violates this EULA;
  3. Permanently ban repeat or severe offenders;
  4. Cooperate with law enforcement when required by applicable law.

Removed content cannot be restored. Banned users may appeal by emailing support@mochilog.app.

6. Blocking

Every user can block any other user through the in-app block action. Once blocked, neither user will see the other's clips, chat messages, direct messages, or profile in any shared group.

7. Privacy

Mochi's collection and use of your information is described in the Privacy Policy, which is incorporated into this EULA by reference.

8. Disclaimer of Warranties

Mochi is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by applicable law.

9. Limitation of Liability

To the maximum extent permitted by law, Mochi shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Service.

10. Termination

You may terminate this EULA at any time by deleting your account from inside the app. Mochi may terminate or suspend your access to the Service at any time, with or without cause, with or without notice.

11. Governing Law

This EULA is governed by the laws of the jurisdiction in which Mochi is operated, without regard to its conflict-of-laws provisions. Specific governing-law and venue terms will be added as Mochi's operating entity is finalized.

12. Changes to this EULA

Mochi may update this EULA from time to time. Material changes will be surfaced in the app or by email. Continued use of Mochi after a change takes effect constitutes acceptance of the revised EULA.
